Agreement

By accessing or using AIMAX, you agree to be bound by these Terms of Service. AIMAX is provided by Agrade Prestasi Sdn Bhd, a MDEC-certified technology company registered in Malaysia. If you do not agree to these terms, you must not use our services.

Service Description

AIMAX is a WhatsApp-based appointment confirmation and reminder system designed for dental clinics, aesthetic clinics, and medispas in Malaysia. Our service includes:

• Automated appointment reminders sent via WhatsApp
• Patient response handling for confirmation, rescheduling, and cancellation
• AI-powered intent detection for patient message processing
• Clinic management dashboard with analytics and reporting

Account Responsibilities

• Each clinic is entitled to one AIMAX account
• You are responsible for maintaining the security and confidentiality of your login credentials
• You must ensure that all patient data entered into AIMAX is accurate and up to date
• You must obtain proper consent from patients before adding their information to AIMAX and sending them WhatsApp messages
• You are responsible for all activity that occurs under your account

Acceptable Use

When using AIMAX, you agree not to:

• Send spam, unsolicited messages, or promotional content unrelated to appointment management
• Misuse the platform for any purpose other than legitimate appointment management
• Violate the Meta WhatsApp Business Policy or any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble any part of the AIMAX platform
• Share your account credentials or allow unauthorised access to your account

Subscription & Billing

• Essential Plan: RM799/month
• Growth Plan: RM1,499/month
• Subscriptions are billed on a monthly basis
• A minimum of 30 days written notice is required to cancel your subscription
• No partial refunds are provided for unused portions of a billing period
• Pricing may be updated with 30 days advance notice to active subscribers

Data & Privacy

Your use of AIMAX is also governed by our Privacy Policy, which details how we collect, use, and protect your data. AIMAX is committed to compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.

As a clinic using AIMAX, you are responsible for ensuring your own compliance with PDPA requirements, including obtaining proper consent from patients for the collection and processing of their personal data.

Service Availability

AIMAX is provided on a best-effort basis. Our service depends on third-party infrastructure including the Meta WhatsApp Business Cloud API and Supabase hosting services. We strive to maintain high availability but cannot guarantee uninterrupted service.

We are not liable for any downtime, delays, or service interruptions caused by third-party service providers, internet connectivity issues, or circumstances beyond our reasonable control.

Limitation of Liability

• AIMAX is not liable for missed appointments resulting from message delivery failures, system downtime, or third-party API issues
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
• Our total aggregate liability is capped at the equivalent of 3 months of subscription fees paid by you
• AIMAX is a communication tool and does not replace professional medical scheduling systems or clinical judgement

Termination

• Either party may terminate the service with 30 days written notice
• We reserve the right to immediately suspend or terminate your account for violations of these terms, the Meta WhatsApp Business Policy, or any applicable laws
• Upon termination, you may request a data export within 30 days
• All associated data will be permanently deleted within 30 days of account termination

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to active subscribers via email at least 30 days before they take effect. Continued use of AIMAX after such changes constitutes acceptance of the updated terms.
